PRIVACY POLICY
At Job Search Television Network (“JSTN” or “we”), we are committed to respecting your privacy. We recognize that when you choose to provide us with information about yourself, you trust us to act in a responsible manner. That’s why JSTN has established this online privacy policy (“Policy”) for www.myjstn.com (www.myjstn.com or any replacement site, the “Site”). This Policy applies only to activities JSTN engages in on the Site and does not apply to JSTN activities that are “offline,” unrelated to the Site, or related to any other JSTN site. JSTN collects certain anonymous data regarding the usage of the Site.

By clicking the “Accept” button during registration or using the Site, you explicitly accept, without limitation or qualification, of the collection, use and transfer of the personal information provided by you in the manner described in this Policy. Please read this Policy carefully as it affects your rights and liabilities under law. If you disagree with the way we collect and process personal information collected on the web site, we recommend that you do not use it.
1. Information Gathered By JSTN
You do not have to give us any personal information in order to perform job searches or to read the content portions of our Site. We collect the following general types of information about you when you visit our Sites: personal information, demographic information, and behavioral information. Sometimes we collect combinations of all these types of information. In each case, it is indicated on the web site whether any personal or demographic data must be provided to use the requested service or not.

Personal information is information that can be used to identify you, or any other individual to whom the information may relate, personally. We do not collect personal information unless you choose to provide it to us. Some examples of personal information that we currently do collect or anticipate collecting in some areas of our Site, depending on the services you use, are:
  • Your name
  • Address
  • Email address
  • Telephone number
  • Credit card number
  • Contact information
  • Billing information
  • Resume content
  • Information about third parties, such as references or contacts, that you provide to us if you have their express written consent to do so
Demographic information is information that is not unique to you in the sense that it refers to selected population characteristics, such as your ZIP code, age, preferences, gender, race or ethnicity, occupation, career history, interests and favorites.

We also collect anonymous behavioral information regarding how you use our Site, the areas of our Site that you visit, what services you access, and information about your computer hardware and software including your IP address, browser and operating system type, domain names, access times and referring Web site addresses. This information is necessary for analyzing the use of resources, troubleshooting problems, preventing fraud, and improving our services.
2. Cookies and Web Beacons
JSTN uses "cookies" to help personalize and maximize your online experience and time online. A cookie is a text file that is either stored in your computer’s memory temporarily (a “session” cookie) or placed on your hard drive (a “persistent” cookie) by a Web page server. Cookies are not used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to your computer and can only be read by a web server in the domain that issued the cookie to you.

When you return to the JSTN site, cookies enable us to retrieve the information you previously provided, so you can easily use the features that you customized. Because of our use of cookies, we can deliver faster and more accurate results and a more personalized site experience. For example, if you personalize JSTN pages, or register for services, a cookie helps us to recall your specific information (such as user name, password and preferences).

We predominately use “session” cookies, which are not permanently stored on your hard drive. Session cookies expire after [[two]] hours of inactivity or when you close your browser. When you carry out a job search a large amount of data is processed by our system and transferred through each page of the search or application process. “Session” cookies allow us to keep track of this data until you have completed your search or application. We also use cookies to identify users who have been banned from using our forums for behavior that contradicts our terms of use and to track click streams, for load balancing and to enable you to navigate through the site using redirection pages.

We use “persistent” cookies primarily to ensure that we do not show you pages that you have already seen and to personalize your site experience and save you time. “Persistent” Cookies enable us to recognize whether you have responded to any poll or seen an advertisement or information notice placed on the Site so that we do not show you the poll, advertisement or notice again the next time you visit our Site.. This information is treated in accordance with the policies and practices described in this Policy. The “persistent” cookies we use will remain on your computer after you have left our Site and will expire when you log out of the Site or [[two years]] after your last visit.
We also allow other companies to display advertisements to you while you are visiting our Sites. Because your web browser must request these advertisements from the other companies’ servers, these companies can view, edit or set their own cookies, just as if you had requested a web page from their site. JSTN has no control over, and is not responsible for, the practices of those third party advertisers. JSTN encourages you to review the policies of such advertisers. (You will find additional information about the following third party ad servers at www.doubleclick.com. We use other third party ad servers as well; a way to opt out of third party cookies is to modify your browser settings to decline cookies as described at the end of this statement.)

We allow persistent third party cookies as part of online advertising campaigns to determine and track site traffic landing from JSTN’s advertising banners that have been placed on the websites of third parties. The data collected via these cookies is anonymous and the information is not linked to your personally identifiable information without your permission. The “persistent” cookies placed by our third party ad servers will remain on your computer after you have left our site for up to 20 years.

You have the ability to accept or decline cookies at any time by modifying your browser settings. If you choose to decline cookies, however, that may hinder performance and negatively impact your experience on the web site.

JSTN web pages may also contain electronic images known as Web beacons (sometimes called single-pixel gifs) that allow us to count users who have visited those pages and to deliver co-branded services. Web beacons are not used to access your personally identifiable information on myjstn.com; they are a technique we use to compile aggregated statistics about our web site usage. Web beacons collect only a limited set of information including a cookie number, time and date of a page view, and a description of the page on which the Web beacon resides.

Because Web beacons are the same as any other content request included in the recipe page, you cannot opt out or refuse them. However, they can be rendered ineffective by either opting out of cookies or changing the cookie setup in your browser.
3. Use and Disclosure of Information
We disclose to third parties your personal information, combined personal, demographic, and behavioral information, as set forth below.

a. We may share your information with third parties who help us in the delivery of our own products and services to you. We disclose information to companies and individuals we employ to perform functions on our behalf. Examples include hosting our web servers, analyzing data, providing marketing assistance, processing credit card payments, and providing customer service. We also use [[Google Analytics]], a tool that sends aggregated anonymous user data to Google U.S. These companies and individuals may be located in a country whose data protection legislation is different from your country, and they will have access to your personal information as necessary to perform their functions, but they may not share that information with any other third party or use that data for any other purpose. We will remain responsible for any information shared in this way.

b. We may disclose such information to third parties if you consent to such disclosure. For example, if you post your resume and make it searchable, then all parties with access to our searchable resume database will have access to your resume. If you indicate by configuring your profile that you would like to receive information about the opportunities, products or services of third parties, we supply your contact information to select third parties such as employers, recruiters, data aggregators, marketers or others for the purpose of sending you e-mail or otherwise communicating with you. We use data we have about you (such as the interests and preferences you have expressed) to determine whether you might be interested in the opportunities, products or services of a particular third party. [[We may also make certain limited personal information, such as your name and email address, available to carefully selected third parties so that they may contact you about products or services that we think will be of interest to you. You will always have the ability to change your preferences or ‘opt out’ of our sharing your data in this way.]]

We also share aggregated anonymous information about visitors to the Sites with JSTN’s clients, partners, other Site visitors, and other third parties so that they can understand the kinds of visitors to the Sites and how those visitors use the Sites. We may also aggregate on an anonymous basis data regarding job qualifications, schooling, age, experience level or other information relevant to the job search or competition among job seekers for any such job. Such data may be made available to employers or fellow job seekers or community members.

Advertisements that appear on the Site are sometimes delivered (or “served” directly to users by third-party advertisers. Such advertisers automatically receive your IP address when this happens. These third-party advertisers may also download cookies to your computer, or use other technologies such as JavaScript and “web beacons” to measure the effectiveness of their ads and to personalize advertising content. Doing this allows the advertising network to recognize your computer each time they send you an advertisement in order to measure the effectiveness of their ads and to personalize advertising content. In this way, they may compile information about where individuals using your computer or browser saw their advertisements and determine which advertisements are clicked. JSTN does not have access to or control of the cookies that may be placed by the third-party advertisers. Third party advertisers have no access to your contact information stored on JSTN unless you choose to share it with them. This Policy covers the use of cookies by JSTN and does not cover the use of cookies or other tracking technologies by any of its advertisers.

c. We disclose information if legally required to do so, if requested to do so by a governmental entity or if we believe in good faith – after considering your privacy interests and other factors – that such action is necessary to: (a) conform to legal requirements or comply with legal process; (b) protect our rights or property or our affiliated companies; (c) prevent a crime or protect national security; or (d) protect the personal safety of users or the public. Because JSTN, Inc. is a US company and information collected on our Sites is stored in whole or in part in the United States, your information may become subject to U.S. law.

d. We may disclose and transfer such information to a third party who acquires all or a substantial portion of JSTN's business, whether such acquisition is by way of merger, consolidation or purchase of all or a substantial portion of our assets. In addition, in the event JSTN becomes the subject of an insolvency proceeding, whether voluntary or involuntary, JSTN or its liquidator, administrator, receiver or administrative receiver may sell, license or otherwise dispose of such information in a transaction approved by the court. You will be notified of the sale of all or a substantial portion of our business to a third party by email or through a prominent notice posted on the Sites.
4. Other Web Sites
Please be aware that our sites, including the Site, may contain links to other sites on the Internet that are owned and operated by third parties. These other sites may send their own cookies or clear GIFs to users, collect data, or solicit personally identifiable information. The information practices of those Web sites linked to our site, or the Site, is not covered by this Policy. JSTN is not responsible for the privacy policies of Web sites to which it links. If you provide any information to such third parties, different rules regarding the collection and use of your personal information may apply. We strongly suggest you review such third-party’s privacy policies before providing any data to them.
5. An Important Note about Your Resume
When you create or post a resume to the Site, that resume is stored in our searchable resume database in the United States. [[You may control the status of your resume by setting it to private or public. If you set your resume as private, it is not searchable by potential employers or other with access to our resume database.]] You may still use your resume to apply online to a job. If you do apply online to a job, your resume will be transferred to the relevant employer, who may retain a copy of your resume or distribute it to third parties, subject to local law. We cannot control their use and retention of your resume information.

We attempt to limit access to our searchable resume database to legitimate users such as paying employers, recruiters, hiring managers, headhunters and human resource professionals, as well as law enforcement and national security agencies, but cannot guarantee that other parties will not gain access to this database. We cannot control the use made of resumes by third parties who access such resumes while they are in our searchable database. You may remove your resume from our searchable database at any time. However, employers, recruiters and others who have paid for access to that database, as well as parties who have otherwise gained access to the database may have retained a copy of your resume in their own files or databases. We cannot control the retention, use or privacy of resumes or profiles that have been downloaded by third parties. Accordingly, you should not put sensitive information, personality profiles, or other information you would not want made public, in your resume.
6. Security
You are responsible for ensuring that your log-in credentials (your username and password) are kept confidential.

JSTN has implemented technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration or disclosure. Notwithstanding such measures, the Internet is an open system and we cannot guarantee that unauthorized third parties will never be able to defeat those measures or use your personal information for improper purposes. When you place an order online at JSTN, your credit card information is protected through the use of encryption, such as the Secure Socket Layer ("SSL") protocol. SSL makes it difficult for your credit card information to be intercepted or stolen while being transmitted. JSTN uses a service company to process its credit card transactions.
7. Children Under Age 13
JSTN does not knowingly collect personal information from children under the age of 13. Children are not permitted to use the Site or services, and JSTN requests that children under the age of 13 not submit any personal information to the Site. If you are under 13 years of age, then please do not use or access the Site or services at any time or in any manner. Since information regarding children under the age of 13 is not collected, JSTN does not knowingly distribute personal information regarding children under the age of 13.
8. Children Between the Ages of 13 and 18
We recommend that minors over the age of 13 ask their parents for permission before sending any information about themselves to anyone over the Internet.
9. Your Choices, Corrections and Updates
We retain all the information we gather about you in an effort to make your repeat use with us more efficient, practical and relevant until you change or remove your personal data as described below. You may have access to, review, correct, update, change or delete your account profile information or resume at any time. Simply log into your account, go to your profile or resume, and make the necessary changes. You may delete your resume from JSTN’s online system at any time by accessing your account. Before providing you with a copy of your personal information or correcting, updating or deleting such information, we reserve the right to verify and authenticate your identity and the personal information to which you have requested access. Access to or correction, updating or deletion of your personal information may be denied or limited by JSTN if it would violate another person’s rights and/or as otherwise permitted by applicable law.

If you wish to delete or close your account or account profile information altogether, please contact us at info@myjstn.com. An email will be sent to you to confirm that your personal information has been deleted (save for an archival copy which is not accessible by you or third parties on the Internet). The archival copy is retained only for as long as JSTN reasonably considers necessary for audit and record purposes. We will retain logs, demographic, indirect, and statistical information about you and keep an archival copy of this information in an anonymized form. If your personal information was previously accessed by others using our Sites, we are not able to delete the information or copies thereof from their systems.

If you previously opted to receive newsletters, commercial e-mails or other communications from MYJSTN or third parties, but subsequently change your mind, you may opt-out by editing your account profile as described above. If you previously opted not to receive such communications, you may later opt-in by editing your account profile.

10. Modifications of the Privacy Policy
JSTN reserves the rights to modify this Policy at any time, and will notify you by prominently posting an amendment to the Policy, or a new Policy, on the Site. Such modifications will become effective on the day they are posted. JSTN encourages you to frequently review the Policy for any modifications.
11. Your California Privacy Rights
California Civil Code Section 1798.83 permits customers of JSTN who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Your data is submitted to Job Search Television Network, LLC, and is hosted and stored by or on behalf of JSTN in a database on servers situated in the United States.
